Oh happy day! I got two dismissals! Both were for failure to prosecute! Our judges are cracking down. If the prosecuting witnesses aren't present when the case is called, the judges are dismissing the cases.
In my first case, the plaintiff had stepped out of the courtroom just before the case was called. When I approached the bench, the judge inquired as to the whereabouts of the plaintiff (she stepped out), and had her called out by the bailiff. When she didn't appear, the judge dismissed the case. As I was walking out of the courtroom, the plaintiff was walking back toward the courtroom. I instructed my client to LEAVE! I had several valid defenses, including a signed arbitration agreement and another document that the plaintiff had signed which would have provided a complete defense to my client, etc., but it was fun to get it dismissed this way.
In my second case, the State's witnesses weren't present. The ADA moved for a continuance and I told the judge that we had been present and ready to proceed at least three times. The judge denied the State's motion, and dismissed the case. Of course, my client still has other charges pending, but we'll take care of those next month.
Note to anyone going to court in Pitt County: Arrive early. Stay in your seat until your case is called.

We have local rules to tell us which court has priority. I was able to cover both cases (see above). Many attorneys handle up to 10 cases a day in competing courtrooms. It's a juggling act. Mine was a little more complicated because I had one in civil and one in the criminal court. Although the criminal court was a priority according to the local rules, I knew that with 571 defendants on the docket, I could go to civil court first (only about 40 cases on that docket) and have the appropriate time for criminal court. When my case got reached, the State's witnesses were already more than an hour late for court, so I spent only about 15 minutes in court as opposed to cooling my heels there for an hour or more.wilson wrote:Seriously...what does one do when this happens? You'd be amazed at how many people aren't in court at their appointed time because they're either in the bathroom or grabbing a last smoke outside the courthouse.
