Did I understand correctly that if they get married, where it's "legal", the state they live in has to honor their union and they would be eligible to receive any rights that a male and female marriage has?

That is one of the problems my wife has had with this whole debate. One of the major points of the constitution is that legal contracts formed in one state must be honored in all states. Sort of the point of the "union." That way, if I get married in Virginia, I don't have to get remarried if I move to California. Or if I drive through a neighboring state, my driver's license is still good and I don't have to pay a fee for owning my car or the stuff in it. Similarly, if a same sex couple gets married in Massachusetts, by the constitution, every state SHOULD have to honor it.

There is a law school class called "Conflict of Laws" that covers what happens when the laws of states differ, I slept through a lot of it but I do remember that where marriage is concerned, a marriage that is valid in one state is valid in another unless the second state finds it against its policy. Taking it out of the same-sex marriage realm, for example, it is legal in Virginia to marry your first cousin, but (surprise) not in West Virginia. But first cousins who marry in Virginia are considered legally married in WV.

I would think in both NC and VA, though, the states would declare themselves to have an interest against same-sex marriage, which is problematic in all manner of situations. The NY case involved a couple who (according to the government) wasn't subject to the spousal exemption for estate tax purposes when one passed away. Not gonna get all PPB on you here, but it's a quagmire. Attorneys on our CA board ask a question related to same-sex marriage about once a month.

I am prosecuting a lady for prostitution this afternoon. Apparently inflation has really hit the Varnish County market. She wanted $200/hr, $130/half hour, $80/fifteen minutes.

In other words, she would make more in an hour than our substitute judge would make all day.

Dang. She must have a graduate degree.

She didn't show up for court. She is from Eden, so I suspect she won't come to VA for a while, and we won't extradite her on a misdemeanor.

She waived attorney. At her salary structure, it's unlikely she would be eligible for court appointed counsel anyway.

Wow. Virginia's rate is $60/hr out of court, $90/hr in court, but for a misdemeanor there's a cap of $120/charge.

I saw an incredibly important person tonight. At least the vehicle must have had a very important person in it since they decided that they didn't need to sit in the line of traffic coming up the hill. This meant that he was heading up the hill in my lane of traffic. Fortunately, the two lanes are wide enough that I could go to the right and avoid him. I really wanted to park the car, chase him up the hill and introduce him to the police officers directed traffic at the four way stop.


OK - I actually wanted to pull the driver out of the car and slap him silly but thought twice before I followed through on that thought.

We had competing fireworks on the island. Most of the crowd went to the beach to watch, while some of us stayed on the front porch. Pretty cool

I expect that this argument will be coming soon to Supreme Court near you.
