The defendant was in a motorcycle accident a couple of years ago. He only has one leg. I don't think he's coordinated enough to manage that....

The guy you are prosecuting for kicking (the kicker) has only one leg, or the defendant (the kickee) has only one leg? Makes a difference!

The kicker/defendant has one leg. (Meanie that I am, I prosecuted him for DUI in the wreck where he lost his leg. He was high and slid his motorcycle under a pickup truck, then sat in the wreckage and texted his friends. Didn't stop texting even when the trooper pointed out his leg was gone.)

It's a small world here in the varnish zone.

So you're prosecuting him twice, once for DUI and then again for assault and battery, a completely separate case?

I already prosecuted him for the DUI, which was a couple years ago. I've prosecuted him a lot of times for different things.
