GIFT or Donation Expense

If this is Public Policy, than delete it.
John Edwards has alot to decide. Either plea deal or go to trial.
If found guilty, he will lose his Law license. Wasn't he teaching at UNC law school?
(I thought the wealthy donors, just gave him money as gifts to support Rielle and her pregnancy). BUNNY gave $700k, and another donor gave $20k per month for monthly housing and expenses. I didn't know it took $20,000 a month for rent, expenses and to buy baby diapers, wipes, formula, food, clothes. Must include services from: Nanny, Security, Limo Driver, and Housekeeper, and Personnel Asst also. An Intern, would have cost less in monthly salary expense. lol
Wouldn't that be considered a Gift to Edwards and not a donation to his former campaign.??

I have never been a John Edwards supporter, but however, I think his children need their Father. Especially the 3 younger children. I always liked hearing from Elizabeth. She was a strong and intelligent woman. Will never forget her interview with Oprah or Larry King.

As I mentioned when this Edwards mess was first news, this Hunter chick's real name is Lisa Druck. When I was in HS down in Ft. Lauderdale in the early 70's, our next door neighbor was a family named Druck, that had two young daughters, ages ~ 7 and 9, one of which was Lisa. I'm 99% sure it is the same Lisa Druck.

I'd think if it was considered a gift to his campaign, he'd be in deep manure for misusing campaign expenses for personal reasons and for exceeding the amount allowed per donor to a political campaign. If it is considered "gifting" to Edwards, I believe gifting laws are such that one can gift $13K/year to another individual without tax/income penalties with some maximum amount allowed per lifetime of the recipient.
Not taking sides here so as to remain apolitical and keep my posting privileges

If it was a gift to an individual, the recipient is not responsible for taxes. The donor is responsible.

Gifts are taxable events to the donor, not the recipient. A couple can double the gift amount to an individual person to $26K/year. I think there's an IRS form that has to be filled out for that to happen.
I believe (and bear in mind, I remember exactly ONE thing from tax law class, that swapping a cow for a bull is not a like/kind transaction) that if a donor passes away, the gifts given for a certain number of years are considered part of the their estate for figuring out taxes on that estate.
I'm also going to keep my opinions to myself as to what I think of John Edwards politically. Personally, I think he belongs in the picture with Arnold the Governator and Arnold the Pig (with apologies to the pig). When a politician's spouse has terminal cancer, that politician ought not to be knocking up the campaign staff.
Or he ought to be man enough to admit it if he does.

I thought there was a dollar amount a donor could GIFT to someone!
SO, how do you explain the $750,000 GIFT ? Or the $20,000 a month?
I don't think the donors were Edwards parents or family giving him a Birthday Gift of Money!
I just don't see how Edwards will spin this one. Trial vs Plea Deal?
I am keeping my personal opinion of John Edwards out of the thought process.

Dang, I just googled it, Ozzie! Lisa Druck is from Ft Lauderdale. She married and became Lisa Hunter. Age 47, born in 1964. Father was an attorney and they raised show horses.

YOUR NEIGHBOR (former neighbor), Lisa Druck "Rielle" Hunter and her Baby Daddy, Johhny, have a big old Federal case.
Does it matter if it is a GIFT or DONATION? Doesnt the DOLLAR amount mean anything in a Trail? I dont know, thats why I am asking the Lawyers of the Forum for their professional answers.
Obviously Johnny boy made a deposit, amd literally got caught with his pants down. Little girl, Quinn is adorable. John Boy is nice looking and book smart. Rielle is somewhat attractive at times, just so skinny and waif looking at times. Their daughter is a beautiful child, from the pictures. And Quinn is an innocent child, from their relationship. And Quinn, and Kate, Jack and Emmy Claire are brother and sisters. The children cant be blamed for the Adults actions and lack of using good sense, judgement or Protection!

Reielle "Lisa Druck" Hunter reminds me of actress Anne Heche. Reille is just much thinner than Anne.

Yeah, I did the Google thing years ago and knew she was from Ft.L. Our neighbor was a judge when we moved in, i.e., also a lawyer. Lisa would have been the younger of the two daughters mentioned above.

Ozzie is connected with everyone. People who don't know Ozzie live in Siberia. Oh, wait....
There is no limitation as to amounts of gifts. I suspect the Senator's friends declared their donations and received tax deductions, rather than paying gift taxes on the gifts. If they were given receipts for tax purposes, it would be difficult for the Senator to say they were gifts.
I don't defend people anymore. When I did, they were usually dirt poor and already had a record and just wanted the best deal they could get. So in my defense work, I never had to deal with the monumental ego the size of John Edwards'. I wouldn't discount his arrogance in trying to guess whether he would accept a plea deal or fight to the bitter end.

According to local news (Wral and Wtvd), Friends of Edwards say he will not take a plea deal.
The news reported there were 2 donors / gifters that gave combined over $2 million.
I was wondering if John Edwards was still getting those $400 haircuts? I don't think Aveda School, Raffles or Great Clips charges those prices (Chapel Hill salons). Perhaps, that was West Coast LA prices!

I could hear the CHOPPERS from the News stations yesterday, as they were circling the EDWARDS ESTATE in Chapel Hill.
Johnny Edwards statement "I did not break the law."
I remember the famous statement, a few years ago "I did NOT have sex with that woman."
Johhny Edwards "I am NOT the Father." (announced Jan 2010, I am the Father). Is this the Maury or Springer show?
The 2 big donors, Bunnie Mellon is 100 years old. If she is handing out GIFT MONEY, I will gladly send her my Bank account number. And the Barron fellow, passed away in 2008.
Showed the 5 attorneys on local news, that are the "DREAM TEAM for Edwards". Thats what I am calling them. Reminds me of the OJ team.

Do you think John Edwards should have taken the Plea Deal, last week? With meant, NO Jail time!
As, Nancy Grace says "Lets unlease the lawyers." So Attorneys on the forum, what is your opinion?
I opt for the Plea Deal. Is it too late to take the plea deal? Seems like a heard a blurb about one of the former aides and emails(several emails) that eluded to the Donation Money was to go to Rielle and her expenses. (wasnt that the coverup of Rielle and John's affair, and little baby Quinn?)
Arnold story, has gotten pushed off the radar with John Edwards indictment. John Edwards is now UPSTAGED with Anthony Weiner and his Weinergate.
WHATS NEXT?
The UNC scandal, still is making the news! Maybe that is to be expected.

In Virginia, if the parties agree, it's never too late for a plea deal, even if the entire case has been heard and the jury is out. Not sure about Federal court though.
I certainly don't have all the facts, so it's hard to make an informed decision. But I think if I were John Edwards, I would take the plea deal and figure on a professorship at unc or a spot as a talking head (heehee, I said head; perhaps this thread is drifting in the direction of Congressman Weiner) on one of the news programs. I would be afraid of little old ladies on the jury who would convict basically because he stepped out on that nice wife they liked on TV while she was dying of cancer. And though this case is said to be weak, the Feds have unlimited resources and no doubt haven't finished digging in on this, and they did manage to get a conviction on a charge in the Barry Bonds case, which seemed flimsy enough to see through.
